By purchasing from BOGO Kratom, you agree wholly to the following terms and conditions. We reserve the right to change these terms, in whole or in part, and any time without notice to buyers.
The term “Seller” refers to the website BOGO Kratom, the company BOGO Kratom, and any person associated with the ownership and operation of BOGO Kratom. The term “Buyer” refers to the purchasing party, individual, organization, or other legal entity purchasing Goods from the Seller. The term “Goods” refers to any and all products or materials covered under the “Contract.” The term “Contract” refers to the agreement between the Seller and the Buyer in exchange for the sale of Goods.
- Age: The purchase of Goods is restricted to persons age 21 and older. At the time of purchase, the Buyer agrees to provide signature or proof of age if requested before or upon the date of delivery.
- Right to Refuse Sale: For any reason and at any time, the Seller reserved the right to deny Goods or services to anyone. Sales to the following states are restricted: Indiana, Wisconsin, and Tennessee. No sales or shipping of Goods to those states will be allowed. Sales to the following countries are also restricted: Thailand, Bhutan, Australia, Finland, Denmark, Poland, Myanmar (Burma), Malaysia, and Lithuania. No sales or shipping to those countries will be allowed. This list is not intended to be comprehensive or exhaustive and may change at any time.
- Shipping: Buyer acknowledges that all efforts will be made by the Seller to expedite the shipping of Goods and that the Seller is not liable for delays. (see shipping policy)
- Personal Information: Buyer affirms that all information provided by the Buyer is true and accurate to the best of their knowledge and is not associated with any third party.
- Refunds and Returns: Refunds and Returns are restricted to unopened packages only. Opened packages and purchases over 30 days from time of service are not eligible for refunds or returns. Refunds may take 72 hours or longer, depending on holiday and weekend schedules.
- Regulation and Risk of Loss: Any and all offers of Goods are void where prohibited. Buyer assumes the risk of loss upon purchase of Goods. Buyer is responsible for loss of Goods resulting from negligence to obey applicable laws.
- Use: Buyer agrees not to hold Seller responsible for any harm or injury resulting from the misuse of Goods. Buyer acknowledges that consumption of Goods constitutes misuse and that Goods are intended exclusively for research and development.
- Severability: Terms and conditions deemed invalid, illegal, or unenforceable shall not alter the validity of any other terms and conditions herein. Each term and condition rests on its own merits, regardless of circumstance.
- Disclaimer of Liability: This agreement removes any and all liability from the Seller for harm or injury resulting from the use, misuse, or purchase of any Goods.
- Choice of Law and Venue: Any transaction of Goods between Seller and Buyer, as well as these Terms and Conditions, are deemed to have occurred in the State of North Carolina. Buyer and Seller agree to resolve any disputes, clarifications, or remedies pursuant to the laws of the State of North Carolina and that all actions or proceedings shall be tried or litigated exclusively in the State or Federal Courts within the State of North Carolina. Buyer gives up the right to contest exclusive venue by any and all motion related to motion to transfer or motion for forum non-conveniens.
By purchasing Goods, the Buyer hereby affirms that:
- a. I am 21 or over and an adult under the laws of the State or Country in which I reside.
- b. Being of sound mind and body and in good health, I am capable of making my own decisions and representations.
- c. LIMITATION AND DISCLAIMER OF WARRANTIES. I understand that all Goods are without warranty, expressed or implied. All Goods provided by the Seller are provided ‘AS IS’ and do not imply fitness of product or merchantability.
- d. Seller is, under no circumstances, liable to Buyer or any third party for damage or injury resulting from misuse or use of Goods. Neither is the Seller liable for damage or injury resulting from actions taken resulting from reliance on views or information provided by the Seller by any means. Waiver of liability includes any and all incidental, consequential, special, or similar damages.
- e. I further agree to hold harmless and indemnify the Seller, or persons associated with the Seller, from any and all damages resulting from the sale, misuse, or use of Goods and that the aforementioned parties shall not be liable under any theory or circumstance whatsoever.
- f. Seller shall not be liable, under any circumstances, for direct or indirect damages whether special, incidental, consequential, or punitive.
- g. I HAVE READ AND FULLY UNDERSTAND THESE TERMS AND CONDITIONS, ANY AND ALL CAUTIONS AND WARNINGS, INCLUDING THOSE PRINTED ON THE PACKAGING. I hereby agree to abide by these cautions and warnings. I will also follow all warnings and cautions regarding product use that are contained on the website.
